Introduction
FeatsClub is a platform that enables organizations ("Organizers") to create and manage ticketed events for their users. We facilitate the ticketing process, collect a nominal processing fee, and provide tools to support both Organizers and Ticket Holders. By using FeatsClub, both Organizers and Ticket Holders agree to comply with this Ticket Policy, our Terms of Service, Privacy Policy, and all applicable legal and tax requirements.
This Ticket Policy is governed by the laws of the State of Missouri, and any disputes will be resolved exclusively in the courts located in Chesterfield, Missouri, in accordance with the governing law clause in FeatsClub's Terms of Service.
Children Under the Age of 13
Facilitation Only
FeatsClub acts solely as an intermediary, providing tools for Organizers to manage events and for Ticket Holders to purchase tickets. FeatsClub is not the producer or organizer of any events and is not responsible for event content, quality, or fulfillment.
Processing Fee
FeatsClub charges a non-refundable processing fee for tickets sold through the platform. This fee is disclosed during the checkout process and may be paid by the Ticket Holder or absorbed by the Organizer, as determined by the Organizer.
Optional Tax Tools
FeatsClub provides optional tools for tax calculation based on event location. These tools are intended to assist Organizers but do not guarantee compliance with tax regulations. Organizers are advised to consult with tax professionals.
Liability Limitation
FeatsClub is not responsible for the accuracy of tax calculations or any event-related liabilities, including personal injury, property damage, or other losses incurred as a result of event attendance.
Organizer Responsibilities
Event Management
Organizers are responsible for planning, promoting, and executing their events, including providing accurate and detailed event information to Ticket Holders.
Tax Compliance
- Sales Tax Determination: Organizers must determine if their event is subject to state and local sales taxes. FeatsClub may assist with tax calculations, but compliance is the Organizer’s responsibility.
- Threshold Monitoring: Organizers must monitor their activity to determine if state-specific economic nexus thresholds are met (e.g., $100,000 in sales or 200 transactions within a calendar year) and take appropriate action.
- Tax Collection and Remittance: Organizers are responsible for collecting and remitting applicable sales taxes to relevant authorities if they meet physical or economic nexus criteria.
- State Registration: Organizers meeting state thresholds must register with appropriate tax authorities to obtain a sales tax permit.
- Tax-Exempt Events: Organizers hosting tax-exempt events must comply with state-specific exemption requirements and provide documentation during event setup.
- Transparency: Organizers must clearly indicate whether ticket prices include sales tax or if it will be added during checkout.
Refund and Cancellation Policies
Organizers must establish, communicate, and display their refund and cancellation policies during the ticket purchase process. FeatsClub is not responsible for processing refunds or handling cancellations unless otherwise agreed.
Record-Keeping and Reporting
Organizers must maintain accurate records of ticket sales, taxes collected, and any exemptions claimed for at least seven years or as required by law. FeatsClub provides sales reports to assist with filing obligations.
Insurance Recommendation
Organizers are encouraged to obtain event liability insurance to cover risks not assumed by FeatsClub.
Ticket Holder Responsibilities
Review of Event Details
Ticket Holders are responsible for reviewing event details before purchasing tickets, including date, time, location, and any restrictions or requirements set by the Organizer.
Adherence to Organizer Policies
By purchasing a ticket, Ticket Holders agree to abide by the Organizer’s policies, including refund, cancellation, and event conduct rules.
Contacting Organizers
For questions or issues related to an event, including refunds or cancellations, Ticket Holders must contact the Organizer directly.
Waiver of Rights
Ticket Holders waive any recourse against FeatsClub for event-related issues unless otherwise specified by applicable law.
Dispute Resolution
Organizer-Ticket Holder Disputes
FeatsClub does not mediate disputes between Organizers and Ticket Holders, including those related to refunds, cancellations, or taxes. Such disputes must be resolved directly between the parties.
Arbitration Clause
Any disputes related to the use of FeatsClub’s platform will be resolved through binding arbitration under the rules of the Arbitration Organization specified in FeatsClub’s Terms of Service.
Tax Disputes
Disputes related to taxes (e.g., incorrect rates or remittance) are the sole responsibility of the Organizer and must be addressed with the relevant tax authority.
Limitation of Liability
Platform Provision
FeatsClub provides the platform "as is" and disclaims all warranties, express or implied, related to its services.
Force Majeure
FeatsClub is not liable for any delays or failures in performance due to causes beyond its control, including natural disasters, pandemics, or other unforeseeable events.
Event Liability
FeatsClub is not liable for any personal injury, property damage, or other losses incurred as a result of event attendance. Claims related to events must be directed to the Organizer.
Amendments to This Policy
FeatsClub reserves the right to modify this Ticket Policy at any time. Changes will be communicated through official channels and will take effect 30 days after posting.
Continued use of FeatsClub constitutes acceptance of the revised terms. Previous versions of this policy will be archived for reference in case of disputes.
